General

“Miki Mottes / Miki Mottes – Shop” is an online website and customer club that sells various products to customers who have registered by creating an account or as guests (hereinafter: the “Website”). The Website is operated by Simple Happy Kitchen Ltd., Company No. 515739324, located at 5 Tel Giborim Street, Tel Aviv (hereinafter: the “Company”).
Wherever the term “Company” appears in these Terms, it shall also refer to the “Website” and vice versa, as well as to anyone acting on their behalf.

These Terms constitute the sole basis for use of the Website and exclusively govern the legal relationship between the Company and the Website user.

The Company and/or anyone acting on its behalf shall not be liable for any direct, indirect, consequential, or special damage caused to the Website user and/or any third party as a result of use of, or purchase through, the Website that is not in accordance with these Terms, including loss of income and/or loss of profit for any reason whatsoever.

The Company reserves the right to amend these Terms from time to time at its sole discretion, without prior notice.

The Website may include links to third-party websites or features. Information on the Website may include content provided by third parties that are not controlled by or affiliated with the Company. For the avoidance of doubt, the Company shall bear no responsibility whatsoever for such third-party services or features. The Company may, at its sole discretion, remove or add links to the Website at any time.

Without derogating from the foregoing and without prejudice to any other remedy, the Company may deny access to any user who, in the Company’s sole and absolute discretion, has performed or attempted to perform any action on the Website in violation of any law, these Terms, or that may harm the Company or its reputation in any way. Electronic records of the Website, including the details entered by customers, shall constitute conclusive and final evidence of the actions performed on the Website.

The Company makes reasonable efforts to ensure that the information presented on the Website is complete and accurate; however, inaccuracies or good-faith errors may occur. The Company shall not be liable for any such information.

The interpretation and enforcement of these Terms and any matter arising therefrom shall be governed by the laws of the State of Israel and adjudicated exclusively by the competent courts in the Central District of Israel. In the event of any conflict between applicable law and these Terms, the provisions of the applicable law shall prevail.

Use of the Website

A “User” / “Customer” is any person who uses the Website’s functions, directly or indirectly, including making purchases, browsing, visiting, or any other use, whether via computer, mobile device, or otherwise.

Each user declares, agrees, and undertakes to comply with the following conditions:

  • Not to transfer, collect, or use any content, details, or information found on the Website, whether belonging to the Company or to third parties.

  • Not to use the Website for any illegal, harmful, or disruptive purpose that may interfere with, damage, alter, restrict, or otherwise affect the proper operation of the Website, including but not limited to viruses, worms, Trojan horses, spyware, malware, or any other destructive technology.

  • To use the Website solely for lawful purposes, in good faith, for personal use only, and not for any other purpose, including unauthorized display on other websites, fraudulent purchases, or any act or omission that may harm the Website, its operation, or third parties.

The Website user declares that they accept all provisions of these Terms and agree to act accordingly.

The purchaser must be at least 16 years old.

Products and Pricing

Product images on the Website are for illustrative purposes only. Differences may exist between the appearance or specifications shown and the actual product. Any error in product description or pricing shall not bind the Company, and the Company shall not be liable beyond the value of the purchased item or for any indirect or consequential damage. The Company endeavors to present accurate images and information.

Sales via the Website are subject to available inventory. The Company does not guarantee continuous availability of all products displayed.

All prices are listed in New Israeli Shekels (ILS) and include VAT if applicable by law, excluding shipping costs unless otherwise stated.

The Company makes efforts to update prices and shipping fees in real time; however, prices may change. If prices are updated before order completion, the customer will be charged the updated price. The Company shall not be liable for any price discrepancies.

The binding price is the price confirmed at checkout.

The Company may offer promotions, discounts, or benefits at its sole discretion and may discontinue them at any time without notice. Refunds for discounted purchases will reflect the amount actually paid.

Registration, Mailing, and Purchase Process

Before making a purchase, customers must complete an order form with personal and payment details. Accurate completion is required. Responsibility for accuracy lies solely with the customer.

Providing false information is a criminal offense and may result in legal action. The Company reserves the right to cancel orders submitted with incorrect or misleading information.

Purchases are subject to approval by the credit card company or PayPal. If not approved, the customer will be notified and charged nothing.

Order completion is contingent upon receipt of a confirmation email.

If confirmation is not received, the customer must notify the Company promptly.

Customers may subscribe to mailing lists and may unsubscribe at any time via the provided link or by contacting customer service.

The Company may send cart reminder emails. Operational messages, including order confirmations and reminders, are not considered promotional messages.

Order Cancellation

Only the ordering customer may cancel a transaction in accordance with the Israeli Consumer Protection Law, 1981.

Refunds will be issued only to the original payment method.

Orders canceled prior to shipment will be refunded in full.

Returns after delivery may be made within 14 business days, subject to the Return Policy.

The Company may claim damages for returned items that have depreciated due to misuse, damage, or opened packaging.

Custom-made products and items specified by law are non-refundable.

Customers must inspect products upon receipt and notify the Company of defects or discrepancies.

In cases of defective or non-conforming products, the Company will refund or replace the item within 14 business days, without cancellation fees.

Cancellation by the Company

The Company may cancel an order in cases including, but not limited to: breach of Terms, incorrect information, harmful activity, illegal use, unpaid debts, technical errors, force majeure events, out-of-stock items, or suspected payment issues.

Delivery and Shipping

Delivery times apply to business days only. Delivery may be via self-pickup, courier, or collection points.

The Company is not responsible for delays caused by third-party shipping services or force majeure.

If permission is given to leave packages unattended, the Company bears no liability for loss or damage.

Out-of-stock items will result in order cancellation and full refund.

Intellectual Property

All content on the Website, including trademarks, designs, illustrations, text, images, audio, video, and graphics, is protected by copyright laws and is the exclusive property of Simple Happy Kitchen Ltd.

Any copying, distribution, modification, or use without prior written consent is strictly prohibited.

All intellectual property rights related to the Website belong exclusively to the Company or are licensed to it.

Privacy and Data Security

The Company values user privacy and takes reasonable measures to protect personal information.

Information is collected voluntarily and through Website usage. It is used for Website operation, service improvement, marketing, communications, analytics, and legal compliance.

Information may be shared with third parties as required for service provision, legal obligations, or business operations.

Users may request deletion of their personal data in writing.

Payment details are encrypted and processed in compliance with PCI DSS standards. Credit card details are not stored by the Company.

The Company is not liable for damages caused by force majeure or unauthorized access beyond its control.
